1. Introduction
Welcome to BollyBooth! These Terms and Conditions ("Terms") govern your use of our services, including the rental of traditional Indian attire such as lehengas and saris ("Items"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
2. Definitions
"Owner": BollyBooth, a Limited Company with its principal place of business at 133 Hamilton Road, London, NW11 9EG.
"Customer": Any individual or entity renting Items from the Owner.
"Items": The traditional Indian attire available for rent, including but not limited to lehengas and saris.
"Rental Period": The agreed-upon period for which the Items are rented.
"Rental Fee": The total amount to be paid by the Customer for the use of the Items.
"Security Deposit": A refundable deposit held by the Owner as security for any damages to the Items.
3. Rental Agreement Formation
Formation of Agreement: A rental agreement is formed when the Owner and Customer mutually agree to the Terms and Conditions of this document, either through online acceptance or by signing a physical copy.
Rental Period: The Rental Period begins on agreed chosen start date and ends on agreed chosen end date or as otherwise specified in the rental agreement.
4. Rental Fee and Payment Terms
Rental Fee: The Rental Fee for each Item is specified on our website and must be paid in full at the time of booking.
Payment Terms: Payment is due immediately upon booking.
Security Deposit: A Security Deposit equal to 60% of the total rental amount is required. The Security Deposit will be refunded within 10 working days of the end of the Rental Period, less any deductions for damages or unpaid fees.
5. Customer Obligations
Property Care: The Customer agrees to maintain the Items in good condition and is responsible for any damages caused by themselves or their guests. Customers may not alter, modify, or sublease the Items.
Compliance with Rules: The Customer agrees to comply with all rules and guidelines provided by the Owner regarding the use of the Items.
Proper Use: Customers must use the Items only for their intended purpose and in accordance with any instructions provided.
Prohibited Actions: Any unauthorized use of the Items will result in forfeiture of the Security Deposit and may lead to legal action.
6. Owner Obligations
Item Condition: The Owner represents and warrants that the Items are in good condition at the beginning of the Rental Period.
Maintenance: The Owner agrees to maintain the Items in reasonable condition throughout the Rental Period.
7. Delivery and Return
Delivery: We deliver Items anywhere within the United Kingdom. Delivery charges will be calculated at checkout.
Return Process: Items must be returned using the pre-paid return label provided, in their original packaging. Items must be shipped back on the last day of the Rental Period.
Late Returns: If the Items are not returned by the last day of the Rental Period, late fees of £25 per day will apply.
8. Cancellation and Refunds
Cancellation Policy: Cancellations made within 24 hours of booking will receive a full refund. Cancellations made after 24 hours may incur a cancellation fee.
Refunds: Refunds will be granted if Items are returned in good condition within the specified Rental Period. Refunds for fit issues will only be granted if the safety seal is intact. Refunds will be processed within 10 working days after the return is processed.
9. Liability and Indemnity
Limitation of Liability: To the extent permitted by law, the Owner is not liable for any personal injury, property damage, or other loss suffered by the Customer or the Customer’s guests, except in cases of gross negligence or willful misconduct.
Customer Liability: The Customer is responsible for any damages caused to the Items by themselves or their guests. In the event of damage or loss, the Security Deposit may be forfeited, and additional charges may apply up to the full retail value of the Item.
Indemnification: The Customer agrees to indemnify and hold BollyBooth harmless from any claims, damages, or losses arising from their misuse of the Items.
10. Dispute Resolution
Negotiation: The parties agree to attempt to resolve any disputes through good faith negotiation.
Mediation: In the event of a dispute, both parties agree to first attempt to resolve the issue through mediation.
Arbitration: If negotiation and mediation fail, the dispute will be resolved through binding arbitration in accordance with the rules agreed upon by both parties at the time of the dispute.
Legal Proceedings: If all other methods fail, either party may pursue legal action in the courts of London.
11. Governing Law and Jurisdiction
Applicable Law: These Terms are governed by the laws of England and Wales.
Jurisdiction: Any disputes arising from these Terms will be resolved in the courts of London.
12. Data Protection and Privacy
Data Collection: We collect the following customer data: Name, Date of Birth, Address, and Gender.
Use of Data: Customer data will be used for processing rentals and for marketing purposes with consent. We do not share customer data with third parties without prior consent, except as required by law.
Data Protection: BollyBooth is committed to protecting customer data in compliance with UK GDPR. Customers have the right to access, correct, or request the deletion of their data at any time.
Customer Rights: Customers can exercise their GDPR rights by contacting us at info@bollybooth.com.
13. Amendments
Right to Amend: BollyBooth reserves the right to amend these Terms at any time. Customers will be notified of any significant changes.
Effect of Amendments: Amendments will not affect rentals agreed to prior to the amendment date.
14. Termination
Termination by BollyBooth: The Owner reserves the right to terminate any rental agreement for breach of these Terms or other valid reasons, including non-payment of fees or material breaches.
Effect of Termination: Upon termination, the Customer must return the Items immediately. Failure to do so may result in legal action.

16. Entire Agreement
These Terms constitute the entire agreement between BollyBooth and the Customer and supersede any prior agreements or understandings.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
18. Force Majeure
The Owner is not liable for any failure to perform due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government actions.
Acceptance of Terms
By proceeding with a rental, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
